There seems to be a common misconception out there so I'd like to clear the air. I come to minyan one day and the gabbai hears that I'm in shloshim. Yet he still looks in the gabbai book to see if there is anyone who has Yarzhiet that day.I'm beginning to wonder why he's looking since I would have first shot at the amud regardles. As it turns out no one did have yarzhiet that day, so there was nothing to talk about. I then began thinking that perhaps yarzhiet has priority over shloshim since it's only once a year. The halacha is not that way however and shloshim does have priority. My Rabbi said however, being that many people are not aware of what the halacha is, you should give it to the yarzhiet to avoid a fight. We also break the minyan into two minyanim to make the amud availble for both parties. Evidently, saying the mourners kadish is only "b'deved" and davening for the amud is "l'chatchila". In Breures only chazzan is allowed to say the mourners kadish for that reason.

My understanding was that Yartzeit has preference. But in some places, it could mean that you never get to daven during shloshim because there's a yahrtzeit every day.
We try to break it up as well.
